I have been intimately involved in franchising my entire professional career. Resolving disputes in a franchise system is markedly different than most commercial settings, litigated or not. Franchising requires parties to continue to work together, many times for years, after the dispute dissipates. No matter the conflict, a continuing joint effort must be made to build and maintain a strong and profitable franchised business and system, all the while presenting an experience that matches their consumer's expectations.

It is these unique franchise realities that lend themselves to mediation as a solid, effective and responsible tool to get past the dispute and back to business. The dual focus, of individual needs, coupled with the needs of the system, require a franchise mediation specialist to guide the parties through the nuances that will craft a solution addressing all the varied interests necessary for a successful and lasting resolution.

In addition to traditional mediation of litigated matters, we have early mediation programs that are cost effective, and allow for the resolution of differences pursuant to mediation provisions in franchise agreements, or in an attempt to resolve conflict at an early stage, prior to litigation.
